Amendments to Building & Fire Code Ordinances Amendments to Building & Fire Code Ordinances
File No. ORD 13-21.The Town of Windsor Town Council will hold a public hearing at its regular meeting on Wednesday, December 4, 2013 at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Windsor Council Chambers, Building 400, 9291 Old Redwood Highway, Windsor. The Town Council will consider adoption of two ordinances amending 1) Title VI Fire Prevention and Protection; and 2) Title VII of the Building and Housing Code. The Ordinances amend Title VI Fire Prevention and Protection, and Title VII of the Building and Housing Code by adopting the 2013 edition of the California Code of Regulations, Parts 1, 2, 2.5, 3, 4, 5, 6, 8, 9, 10, 11, and 12, Title 24, as published by the International Code Council including tables and appendices. Copies of each Code along with the full text of the proposed Ordinance are available for public review during normal business hours at Town Hall, 9291 Old Redwood Highway, Building 400, Windsor, CA 95492, (707) 838-1000. The proposed ordinances, as set forth in Title VI and VII include provisions related to administration, definitions, fire sprinkler systems, penalties, permit exceptions and equivalent or more stringent green building requirements. The Ordinances also contain the findings of fact that are required by Health and Safety Code Sections 17958.5, 17958.7 and 18941.5 relative to local climate, geological and topographical conditions supporting the amendments made to the building standards contained in the California Building Standards Code.

The purpose of the amendment is to update the Ordinance to be consistent with the provisions of the Town of Windsor Municipal Code, which includes provisions for the days and hours for construction activity and procedures to seek relief from the restrictions.

The Town of Windsor has received an appeal from Andy Gustavson/Landmark Planning and Permit Service, requesting the Town Council reconsider the Planning Commission’s denial of an appeal, which upheld the Planning Director’s determination of inconsistency with the Town’s General Plan, Zoning Ordinance, and Economic Development Strategic Plan to locate an off-site stand alone PV Solar array on vacant property within the Town boundaries on Aviation Blvd, APN 059-271-063/-064. General Plan: “LI” (Light Industrial); Zoning: “LI” (Light Industrial). The consideration of the appeal by the Town Council is exempt from the requirement of CEQA.
Station Area Plan Station Area Plan
PPR 09-46, The Station Area Plan will lay the foundation for transit-oriented development surrounding the Town’s Downtown Transit Station. The Station Area Plan covers a roughly one-half mile radius around the Town’s Intermodal Transit Station, encompassing the business and cultural center of the Town. The primary goals of the Plan are to advance Smart Growth principles by creating pedestrian-friendly environments, replace an outdated Downtown Plan (1997), align development with greenhouse gas emission reduction targets, further the recommendations of the Sustainable Design Assessment Team Report (2009) and further the recommendations of the Economic Development Strategic Plan (2008). The Station Area Plan will affect the permitted uses and intensity of uses of real property within the downtown area which is generally within ½ mile of the SMART Transit Station. Wednesday, January 18, 2012 at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Windsor Council Chambers, Building 400, 9291 Old Redwood Highway, Windsor. The Town Council will consider the following: 1) Certification of the Environmental Impact Report for the Station Area Plan, and 2) Adoption of the Station Area Specific Plan.

Town Council of the Town of Windsor will conduct a public hearing on December 7, 2011 at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Windsor Council Chambers, Building 400, 9291 Old Redwood Highway, Windsor, to consider final action on a request from Jeff Civian/OSL Management LLC requesting the following approvals and entitlements associated with the Bell Village Project: Use Permit (including Site Plan and Design Review) and tentative map approval of a commercial and residential planned development including 387 dwelling units (condominiums and townhouses) and an 83,500+/- sq. ft. retail center on 25+/- acres. The use permit also includes a request for parking reductions as well as a drive-through service window for a proposed pharmacy, and a variance to commercial building height limits is requested. A General Plan Amendment is requested to amend the land use category from the existing “Mobile Home Park (8-12 units/acre)” category to the “Compact Residential (12-32 units/acre)” on 18.7 +/- acres, “Retail Commercial” category on 6.0 +/- acres, and “Service Commercial” on 0.2 +/- acres. A Rezoning is also requested from the existing “Medium Density Residential (8-12 units/ acre)” to the “CR-24” (Compact Residential, 24 units/acre)” district on 18.7 +/- acres, “CC (Community Commercial)” district on 6.0 +/- acres, and “SC (Service Commercial)” district on 0.2 +/- acres or other districts consistent with the General Plan to accommodate the project. The Town Council of the Town of Windsor will hold a public hearing at the Town of Windsor Council Chambers, 9291 Old Redwood Highway, Building 400 on Wednesday, November 16, 2011 at 6:00 p.m., or as soon thereafter as the matter may be heard, to consider a proposed ordinance amendment to Title VII Building and Housing Section 7-1-190, Construction Working Hours. This proposed amendment will affect the days and hours in which construction activity is exempt from the Town’s construction regulations and will establish a procedure to seek relief from the restrictions of the Municipal Code.

The Town Council will consider the following: (1) adoption of a resolution accepting Windsor Mill Project (Revised) applicants’ request to withdraw from further consideration of Growth Control Allocation Reservations, designation of the Windsor Mill Project (Revised) as a potential priority development, and the current Windsor Mill Project (Revised) proposal of up to 425 units at a future workshop to determine project merit and appropriate processing; (2) adoption of a resolution setting Growth Control Allocations for 2012; and (3) adoption of a resolution Reserving Allocations for 2013-2014. The Town Council will provide staff direction on review and potential recommendations to the existing Merit Presentations Process and Procedures.

The Town of Windsor Town Council and Planning Commission will hold a joint public meeting on Tuesday, August 10, 2010 at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Windsor Council Chambers, Building 400, 9291 Old Redwood Highway, Windsor. The Town Council and Planning Commission will consider preliminary design alternatives for the Downtown section of Old Redwood Hwy., between Windsor River Rd. and Windsor Rd. The purpose of this meeting is for the Town Council and Planning Commission to receive a presentation on design alternatives and to offer comment. NO ACTION WILL BE TAKEN.

The Town of Windsor Town Council will hold a public hearing at its regular meeting on Wednesday, June 2, 2010 at 6:00 p.m., or as soon thereafter as the matter may be heard, in the Windsor Council Chambers, Bldg. 400, 9291 Old Redwood Highway, Windsor. The Town Council will consider adopting a resolution approving Old Red Going Green, A Sustainable Design Assessment Team (SDAT) Final Report, as a policy document for sustainability. The SDAT Final Report has been determined to be exempt from the provisions of the California Environmental Quality Act, Section 15262.

The following development proposals will be making a merit presentation: Project: File No. PRE 10-13: Windsor Mill (Redesign) / Gaye Quinn Location: 8629, 8709, 8711, 8713, 8716, and 8777 Bell Rd.; 8955 Conde Ln.; 366 Johnson St.; and 8820 Larsen Wy. Description: 270-Unit Planned Development Project: File No. PRE 10-14: Windsor Creekside Village / Richard Deringer Location: 8225 Conde Lane Description: 179-Unit Mixed-Use Planned Development The Town Council/Planning Commission will hear a merit presentation on the above proposals, which require Growth Control Allocations. The developer will be provided one half hour to present the merits of the proposed development for the purpose of prioritizing residential development for future allocation years. Public comment will be received following the conclusion of the final presentation.

The Bell Village Project is a planned development including 400 residential units and 6+/- acres of commercial development.
